These Terms govern your use of Florophilia (the "Service"), operated by Mars Vision, LLC ("we", "us"). By using the Service you agree to them. If you do not agree, do not use the Service.
Florophilia is a field guide and a course in botany. Parts of the Service are free to use. A membership unlocks additional features, including saving, sharing, and the tools and exports. We may change, add, or remove features at any time.
Membership is a subscription. The price and term are shown before you buy, and the subscription renews until you cancel. On iPhone it is billed by Apple through the App Store; on Android by Google through Google Play. You can cancel through the store you bought it from, and membership continues until the end of the paid period. Refunds are governed by that store's policy. Where membership purchase is not yet available in your version of the Service, choosing Join records your interest and nothing is charged.
Plant information in the Service is for general education. It may be incomplete or wrong. It is not medical, safety, or professional advice. Never eat, handle, or use a plant on the basis of anything in the Service. Many plants are toxic, and an identification here is no substitute for an expert. You rely on plant information at your own risk.
You must be at least 13 years old to create an account. You are responsible for activity under your account and for keeping your login secure. You can delete your account at any time from Settings.
You own what you create. When you make content public or post a comment, you grant us a license to display it within the Service, with your display name, for as long as it remains public. You are responsible for your content and confirm that you have the right to post it. We may remove content or suspend accounts at our discretion.
Do not misuse the Service, interfere with its operation, access it by automated means, or post content that is unlawful or infringes the rights of others.
The Service, including its design, illustrations, text, and data, is owned by us or our licensors and is protected by copyright and other laws. You may use it for personal, non-commercial purposes within the Service. Do not copy, scrape, or redistribute it without our written permission. Photographs and other third-party material remain under the terms of their own licenses.
Plant photographs in the Service come from public collections and are shown with the photographer's name and license. Tracings you make from a photograph are for your own study, and the Service limits what can be shared or exported where a license requires it. A rights holder who does not want a photograph to appear can write to info@florophilia.com and it will be removed.
If you believe content on the Service infringes your copyright, write to our designated agent, registered with the U.S. Copyright Office (DMCA-1080038): Copyright Agent, Mars Vision, LLC, info@florophilia.com. Include the work, where it appears on the Service, your contact details, and a statement, under penalty of perjury, that you own the work or act for its owner. We remove infringing content promptly and close the accounts of repeat infringers.
The Service uses third-party services, including app stores, hosting, and public data and image collections. We are not responsible for their content or availability, and your use of them is subject to their terms.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive, including those on content, disclaimers, liability, and governing law, survive termination.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be accurate, uninterrupted, or error-free.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or fifty dollars.
You agree to defend and indemnify us against claims, losses, and reasonable legal costs arising from your content or your breach of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts of Los Angeles County, California, and you consent to their jurisdiction. Nothing in these Terms limits rights you have as a consumer under the law of the place where you live.
These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. We may update these Terms; the date at the top changes when we do, and continued use after a change means you accept it.
